MOTORCYCLE INSURANCE COVERAGE
When insuring a motorcycle, the owner cannot purchase first party benefits, such as medical benefits and income loss benefits. In Florida, this is referred to as Personal Injury Protection, or PIP. In addition, the requirement of sustaining a permanent injury is not required, thus, there is no restriction on recovery for pain and suffering. However, many areas of motorcycle law are in a state of flux. Our courts have yet to decide whether a motorcycle owner who is injured in an accident can stack uninsured and underinsured motorist benefits for the automobiles that are in the owner's household. Our courts have also not decided whether private health insurers can subrogation claims against the motorcycle owner in the event of recovery.
Motorcycle accidents are becoming increasingly common as our roadways become more congested and drivers have more distractions. These types of accidents can cause serious, permanent injuries and financial hardships affecting the victims and their families. Motorcycle riders are 4 times more likely to be injured in an accident and 21 times more prone to fatality. While motorcycles make up less than 2% of all registered vehicles in the United States, motorcyclists account for 8% of all traffic deaths. According to the Motorcycle Safety Foundation's (MSF) most recent report (2001), motorcycle crashes in the U.S. increased by 0.57% to 76,337 and motorcycle fatalities increased by 3.89% to 2,909. Out of the 2001 data collected, Florida had more motorcycle accidents, injuries and deaths then any other state. A common cause of motorcycle accidents is the at-fault driver's failure to see and/or recognize motorcycles in traffic. In two-thirds of those accidents, the driver of the other vehicle violated the motorcyclist's right-of-way causing the accident. Additionally, many motorcycle accidents occur when the driver of a car misjudges the distance and speed of the motorcycle and makes a left-turn into the oncoming motorcyclist.
